The Mayor, The Police Commissioner and the Constitution.
No, that's not the beginning of some dumb joke about walking into a bar. It is a reminder to the noise machine currently blustering about the 9/11 trials that Attorney GeneralHolder announced will take place in New York.

I don't know what flavor of Kool Aid Rudy Giuliani has been drinking lately but just a few years ago he was a strong supporter of terror trials in New York. Now he appears to be scurrying to the farright as fast as he can. I don't think it will do his political future much good. Any tea-party approved opponent of Mayor Giuliani will just have to whip out those New York Gay Pride photos of the then-mayor in drag.

The fact is that the current mayor Michael Bloomberg and police commissioner of the city of New York Raymond Kelly, both support the idea of holding the 9/11 trials in their city. I happen to think their opinions are infinitely more informed and objective than those of Fox News personalities like Karl Rove who called the trials a plot hatched by left-wing lawyers who do not love America.

But the final arbiter of it all is the United States Constitution, specifically article 3 section 2.

It really is a shame that so many of the people who profess to be "strict constructionists" of the constitution, really don't believe in it. Read the constitution yourself. The right to a jury trial is not dependent on being an American citizen. The right to a jury trial includes the right to have that trial take place in the location where the crime was committed.

Yes, 9/11 was a heinous crime. But from a legal standpoint, it is no different than someone sneaking across the border, robbing a bank, and killing people in the process. Right wingers are trying to make some kind of political hay out of this. In the best tradition of fear mongering and mushroom clouds over Chicago, they warn of the dire consequences. Terrorists will target New York anew. As you listen to their arguments, one thing becomes crystal clear. The constitution is never mentioned.

Khalid Sheikh Mohammad and others will be moved from Guantanomo and tried in civilian federal courts. This is as it should be. As far as I am concerned, the hatred of America comes from those who would claim otherwise. Every elected official takes an oath to preserve, protect and defend the Constitution of the United States. It is sad that so many on the right would toss the constitution into the trash can in a feeble attempt to gain temporary political advantage.

Opposing opinions are welcome. There is only one requirement. Please cite the article, amendment or section of the constitution that backs up your opinion. thanks...



Section 2 - Trial by Jury, Original Jurisdiction, Jury Trials

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; to all Cases affecting Ambassadors, other public Ministers and Consuls; to all Cases of admiralty and maritime Jurisdiction; to Controversies to which the United States shall be a Party; to Controversies between two or more States; between a State and Citizens of another State; between Citizens of different States; between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

Don't you know that these are Super Terrorists who can bend steel with their bare hands, and the can use mind bending powers to get the guards to do as they please?

These terrorist's associates will be planning to break these captive terrorists out of these super secure prisons just like they do in the movies.

You have to realize that Americans are just simple folk and are no match for the super powers of the terrorists!

How dare you blow things out of proportion and promote fear mongering. Are there no patriots out there that is proud to be an American, and who isn't afraid of their own shadow?

America has tried and convicted terrorists in the past, and no one has attempted to break them out, nor have they used super powers to get out.

Have a little pride in your country and its ability. I know its let you down over the last 30 years, but things are changing.

I DO HAVE PRIDE IN MY COUNTRY, WHICH IS WHY I SUPPORT OUR TROOPS AND LISTEN WHEN THEY TELL ME THEY BELIEVE IN WHAT THEY ARE DOING, AND BELIEVE THESE MONSTERS DON'T DESERVE A REGULAR TRIAL. THESE ARE SLIME THAT WOULD THINK NOTHING OF BLOWING UP MORE INNOCENT PEOPLE IN THE SAME VULNERABLE SPOT THEY KILLED THE OTHER 3,000. YOU CAN MAKE LIGHT OF SOMEONE WHO FEARS WHAT THESE ANIMALS ARE CAPABLE OF..JUST WISH YOU HAD TO ANSWER TO THE 3,000 FAMILIES AND FRIENDS AT JUST HOW FUNNY THEY THINK IT IS.

Let 12 of the people of New York, who were ravaged by his terror, convict KSM. Stand up and show that we are not afraid to put this man in public and convict him of his crimes.

What I find funny all these fearfull people claim to be religious and believe in God. Their only goal is to please god and be with him. What better way to be with your god than in death. Why are they afraid to die if they by their belief are going to a better place. I do not know why they fear being in the place they lived their whole life to get to.
Unless they really do not believe what they claim.

Republican many of the families that lost loved ones that day want this to take place so they can move on with their lives.

Well, good luck finding 12 jurors who can claim to be impartial. There are too many things that can go wrong, all it will take is one juror to talk when he's not supposed to and there goes your mistrial. Why take the chance. I say kill the S.O.B. before he gets to trial and save us all the time and money. Hey Dawn, since you are not a religious person, how do you claim to know so much about "their only goal is to please god and be with him" ?? that's not my only goal. I think you have it backwards, the terrorists only goals are to kill us all so they can get to a better place.

The constitution and the principles of this free and great country is the reason that there will be a trial. This isn't the evil empire anymore now that the constitution hating right is our of control.

One of the Fox Party gods, Bill O'Reilly has stated "I don't care about what the constitution says." Represents the right and their beliefs.

So repub, join us as proud Americans who believe that for over 200 years we have faced just about every challenge we have confronted by following our founders beliefs that a principled approach using the constitution as our guide will bring the results that we expect. From your writings here, you are a fearful person with no confidence in the American principles. Too bad for you.

In no way am I trying to insult you or your feelings/opinions. We have a system in place that has worked for over 200 years, and we need to have faith in it.

There is no way and no how will the guilty walk. If you have any fear, it should be that the last administration took take steps beyond their responsibilities and the laws of the land that could disqualify evidence.
